1. Scope (GTC — January 2023)
These General Terms and Conditions (GTC) govern online sales to users via dedalshop.ch (Dedalshop brand), operated by Dedal Services AG, UID CHE-221.348.585, Steinwiesenstrasse 3, CH-8952 Schlieren, Switzerland (“Dedal”). They also apply to transactions under the Dedal reseller programme where active: selected independent resellers may offer products in their own name through Dedal online shops. Together with the site terms of use (GC/TOS) and the privacy policy they form part of the contractual relationship. By creating an account you confirm you have read the GTC. Dedal may amend them; the version in force at the time of each order applies. Conflicting customer terms are not recognised.
2. Target customers, territory, minimum age
The online offer is aimed at customers with residence or registered office on the European continent; deliveries are made to addresses on the European continent. The offer applies while the product is available via the shop search and/or while stocks last. For products with a minimum age of 18 (e.g. alcohol, tobacco) you confirm compliance with the law by submitting the order. Orders in unusual volumes may be refused without stating reasons.
3. Products, final prices, small-order surcharge and reseller imports
Illustrations in ads, brochures or online are indicative and not binding. Published prices are final prices including VAT, any advance recycling contributions (vRG), packaging, shipping and other charges unless expressly excluded. If the basket total is below CHF 50.00, a small-quantity surcharge of up to CHF 9.00 may be added. Dedal and resellers may change prices; the price at the time of ordering is decisive. If you order from a foreign reseller not registered for Swiss VAT, you are liable as importer; you authorise Dedal (or a third party) to file the import declaration and pay Swiss import duties on your behalf, with advance payment by you; any difference between prepayment and actual duties is refunded. You may object to the import-duty notice within seven (7) working days of receipt or collection; after that period you may no longer claim defects in that notice. Additional services (assembly, disposal, warranty extension, etc.) are not covered by the import notice and are shown separately in the cart and on the invoice.
4. Availability, delivery times and COâ‚‚ contribution
Dedal aims to keep availability and delivery-time information current; delays may still occur (including at resellers or due to production). All such information is therefore without guarantee. Where enabled, you may contribute up to 5% of the goods value towards offsetting COâ‚‚, as shown in the order summary; Dedal collects this with a third-party provider and may support selected environmental projects. After the order is prepared for shipment the climate contribution is non-refundable. Dedal does not warrant the accuracy of climate-related information or calculations.
5. Formation of contract and contractual partner
Products and prices in the shop constitute an offer subject to cancellation if delivery is impossible or the price is incorrect. For Dedal products/services the purchase contract is concluded with Dedal Services when you order online and—where offered—through other official Dedal channels (phone, e-mail, stores). For reseller products the contract is between reseller and customer; Dedal acts only as intermediary and service provider for the reseller and is not a party, unless the shop and invoice state otherwise. For certain Spanish resellers not Swiss VAT-registered, the contract price may be in euros and payment in Swiss francs. Automated order confirmation is not a firm promise of delivery: it confirms receipt and that the contract with Dedal or the reseller is formed if delivery is possible and the price is correct.
6. Delivery date and material delay
The provisional delivery date is given with the order confirmation or agreed individually. If Dedal or the reseller is late, except for special orders you may withdraw from the contract from the 30th calendar day after the originally announced delivery date; advance payments already made will be refunded. No further claims against Dedal or the reseller arise from that delay.
7. Delivery, pickup and extra costs
Delivery and pickup options for Dedal products are those published in the shop (e.g. Shipping page). Products bought from a reseller may only be delivered by mail order. The address must be on the European continent and reasonably truck-accessible; otherwise extra costs are for your account. If you choose delivery to the place of use, you must ensure access (stairs, doors, etc.); if the product cannot be brought to the place of use, extra costs are for your account. If you do not accept goods on the agreed delivery date or do not pick up in-store within 14 calendar days after goods are ready for pickup, Dedal or the reseller may cancel the contract and charge delivery costs and any loss in value.
8. Duty to inspect and report defects
You must immediately inspect delivered or collected goods for correctness, completeness and transport damage. For freight-forwarder deliveries, note damage on the delivery note. Damage, wrong or incomplete deliveries must be reported to Dedal (including for reseller goods) within 48 calendar hours of delivery or pickup via your personal account under “Returns, repairs and service”. Do not put the product into operation; keep original packaging and follow the return instructions in your account.
9. Warranty and used goods
Under the full GTC, Dedal or the reseller warrants that the ordered product is free of defects and functional for two years from delivery or store pickup, with repair, replacement, credit or reduction as described in the legal pack. Wear parts (batteries, power supplies, lamps, software issues, etc.) may be excluded as stated there. Different rules may apply to discounted items marked “New + Tested” or “Used + Tested” (including a one-year period and stated optical defects). For data carriers, total data loss may occur; you are responsible for backups. Mandatory consumer rights under the law applicable in your country remain unaffected.
10. Liability
Liability follows applicable law with the limitations and exclusions set out in the full GTC (ordinary negligence, indirect and consequential loss, delivery delay, misuse, incompatible spare parts, third-party repairs, force majeure, etc.). For websites, see also the Disclaimer.
11. Payments, default and retention of title
Payment claims for purchases via Dedal online shops may be enforced by Dedal directly against the customer; resellers may assign their claim to Dedal (assignment accepted by the customer), with payment in Swiss francs unless otherwise lawfully stated. Methods and fees are those offered under Payments / at checkout. Card or instant payment may be charged when the order is placed; advance payment means shipment only after receipt of funds, with reservation rules as in the full GTC. Consignment-invoice rules (where permitted for Dedal goods only) follow the 20-day terms in the full GTC. On default, reminders may incur fees (e.g. CHF 5 / CHF 20), up to approx. 15% annual interest and referral to a collection agency. Goods remain the property of Dedal or the reseller until paid in full; transfer, pledge or processing without written consent is not allowed.
12. Order changes, cancellation and impossibility
Orders oblige you to accept the goods and services. Later changes or cancellations may be accepted at discretion against a handling fee of up to 20% of the cancelled order value (minimum CHF 60) plus loss in value. If delivery becomes (partially) impossible after the contract is formed, you will be informed by e-mail; if you already paid, you are refunded; if not, you are released from payment. Further claims for delay or non-delivery are excluded to the extent stated in the GTC.
13. Withdrawal and return of non-defective goods
Statutory or contractual withdrawal for eligible products follows the withdrawal conditions / Returns page and the product page (“Return and guarantee”). Register the return from your account or the dedicated section on dedalshop.ch (or related domains stated in the legal pack), pack correctly with accessories and original packaging; damaged goods may be rejected or charged in full. On withdrawal, Dedal refunds the purchase price minus any small-order surcharge and withdrawal costs stated in the instructions; clothing and shoe returns may be free as in the GTC. For returns involving import duties paid on your behalf, you authorise Dedal to file export customs declarations and reclaim Swiss import duties; you warrant the accuracy of return data and indemnify Dedal against third-party claims from incorrect declarations.
14. Community
By submitting comments or contributions to our community you accept the applicable Dedal community rules.
15. Final provisions, venue and governing law
Returns that cannot be attributed to a customer may be stored for six months and then disposed of. Warranty goods not collected from a branch within six months of a collection request may be disposed of as in the GTC. The privacy policy applies to personal data. If a clause is invalid, the remainder stays valid. Relationships are governed by Swiss substantive law; the UN Sales Convention (CISG) does not apply. Exclusive jurisdiction follows the detailed rules in the full GTC (consumers: domicile or Zurich where Dedal is a party; entrepreneurs in Switzerland/abroad: as in legal section 13.5). Copyright in the GTC text is reserved by Dedal.
